Jury awards $1.2 million medical malpractice award to Crandall & Pera Law client

Crandall & Pera Law Attorney Marc Pera recently won a significant victory for his client, Victoria Stamper and her husband Steve, in a medical malpractice case against Michael Draznik, M.D.

Dr. Draznik performed two surgeries on Victoria to remove her uterus, fallopian tubes and ovaries. A portion of her fallopian tube was inadvertently left in during the second surgery, causing abdominal and pelvic pain.

On July 8, 2011, Dr. Draznik performed a laparotomy (open abdominal surgery) on Victoria to remove the tubal remnant and scar tissue. Following this surgery, Victoria had a fever, fast heart rate, high white blood cell count, and other symptoms consistent with a bowel perforation.

By the time the perforation was diagnosed after a four day delay, Victoria was septic and had developed acute respiratory distress syndrome (ARDS) and permanent lung damage.

After a two week trial and three days of deliberations, a Hamilton County jury found in favor of the Stampers and awarded them $1.2 million, including $425,000 for Steve Stamper’s loss of consortium.
