Delayed/Negligent C-Section

Did A C-Section Mistake Cause You Or Your Child Injury?

cpw-design-element

A C-section (cesarean delivery) might be planned ahead of time if the mother develops pregnancy complications. However, the need for a first-time C-section might not become obvious until labor is underway. A delayed C-section, especially where there are signs of fetal distress, puts the baby at risk of life-threatening disability or death. An improperly performed C-section can cause serious injury to both mother and baby.

Crandall & Pera Law represents families throughout Ohio who were harmed because of negligence by health care providers during labor and delivery. Our team of registered nurses and experienced birth injury / birth trauma lawyers provides skilled legal service tempered by sympathetic understanding of our clients' needs.

Reasons For Emergency C-Sections

There are several situations where a C-section can be a safer alternative – for both mother and baby – than a vaginal delivery. A C-section may be recommended in cases of:

  • Lack of cervix dilation, despite several hours of strong contractions
  • Low oxygen or heartbeat changes, which can be an indication of fetal distress
  • Abnormal fetal position, which is particularly common in the case of multiple births
  • Placenta irregularities, including blockage of the cervical opening
  • Umbilical cord problems, such as oxygen deprivation or strangulation

A C-section might also be recommended if the mother has a serious medical condition or if an infection would pass to the baby during a vaginal delivery. An obstruction in the birth canal or an infant's hydrocephalus are also reasons for a c-section to be considered.

Delayed C-Sections Due To Medical Negligence

There can also be catastrophic consequences from delaying a C-section for too long. One type of instance is when a mother and child are kept in delivery for a long period of time despite signs of fetal distress as evidenced by a suboptimal oxygen level or concerning changes in the baby's heartbeat. The resulting hypoxia, a lack of adequate oxygen supply, can cause massive injury to the child. If too much Pitocin was used to move labor along, the chance of injury can be worse.
